Selenski attorneys again want charges dismissed STAFF REPORT 10/24/2006
Attorneys for accused double-murderer Hugo Selenski have asked for all charges against their client to be dropped for the second time in less than a week.
The Luzerne County district attorney’s office failed to present enough evidence for Magisterial District Judge James Tupper to bound the case against Selenski, 33, over for trial, according to a motion filed Monday by Stephen Menn, John Pike and Michael Senape. Selenski and Paul Weakley, his alleged accomplice, are accused of the 2002 murders of Michael J. Kerkowski and Tammy Fassett.
Monday’s motion discredits all the charges, but coincides with Pike’s attempt to have the robbery and conspiracy to commit robbery charges dropped at Selenski’s hearing in June. There is no evidence to suggest Kerkowski and Fassett were robbed before they were killed, Pike said at the June hearing. He pointed to Kerkowski’s late father finding $40,000 at the Tunkhannock-area pharmacist’s home after he and Fassett went missing. Kerkowski’s wallet and Fassett’s jewelry also were discovered by Michael S. Kerkowski, the murder victim’s father, Pike said.
Luzerne County Judge Chester Muroski will rule on the motion, which, if successful, would eliminate the prosecution’s ability to seek a second-degree-murder conviction against Selenski. In order to be convicted of second-degree murder, a defendant must be found guilty of killing someone while committing another felony crime, like robbery.
Luzerne County District Attorney David Lupas could not be reached for comment Monday.
Selenski declined a request for an interview Monday from The Citizens’ Voice. He was transferred back to Luzerne County Correctional Facility on Monday for a status conference in the case, scheduled for today at 9:30 a.m. before Muroski.

Damn, quite a bold move by Hugo's lawyers! Anyone else hear about this in the TL or CV or any other paper? I didn't see it on the news.

WILKES-BARRE — In a bold move Friday, defense attorneys for accused murderer Hugo Selenski filed a motion asking for all charges against their client to be dismissed claiming they have not received the necessary information to prepare an adequate defense.
Luzerne County District Attorney David Lupas’ office fired back only hours later with its own motion saying if attorneys Stephen Menn, John Pike and Michael Senape are not prepared it’s their own fault for failing to retrieve 20,000 pages of documents associated with the case. Those documents will satisfy their request, according to the prosecution’s response.
Luzerne County Judge Chester Muroski, expected to preside over Selenski’s trial tentatively scheduled for January 2007, will rule on the defense’s motion. At the very least, Menn, Pike and Senape want Muroski to compel the prosecution to provide its theory on how Selenski and his alleged accomplice, Paul Weakley, robbed and strangled Michael J. Kerkowski and Tammy Fassett in 2002.
“Without this crucial information, it would limit an effective presentation of a defense,” Pike said early Friday afternoon, before the prosecution’s response.
But the district attorney’s office’s attempts to set up dates and times to provide discovery information have gone unanswered, Lupas’ motion said.
“The defendant’s request for a bill of particulars (theory of the crime) is nothing more than an additional discovery request in disguise,” the prosecution’s motion said. “Our courts have determined that the (prosecution) is not required to answer such ‘backdoor’ attempts to obtain (evidence).”
Senape challenged the prosecution’s assertion the defense is failing to pick up the necessary documents when contacted Friday night, after the district attorney’s office filed its response.
“I have personally been there three times and have received over 4,000 pages of discovery and over 9,000 pages of phone records,” Senape said. “I just think their motion misrepresents the facts.”

i have to do a sleep study at the hospital- i'm nervous! i'm tired and sleepy but i bet i won't be able to sleep tonight. has anyone else gone through one of these studies before?
i'm going to the eagles game on november 19th with dennis! i got club seats from my friend mindy and i can't wait!!!
