 Judge: Selenski back to state

Update: Judge says Selenski should go back to state

WILKES-BARRE – - A judge on Thursday said he has no authority to move homicide suspect Hugo Selenski from a state prison to the county prison.

Judge Chester Muroski made the decision after a brief hearing Thursday.

Selenski, 33, has been jailed at the State Correctional Institution at Frackville where he is serving a two-year sentence for burning the bodies of Adeiye Keiler and Frank James.

A jury convicted him of the charges last year. The same jury cleared him of killing the two men.

But Selenski and Paul Weakley were later charged with killing Michael Kerkowski and Tammy Fassett.

Selenski and Weakley are awaiting trial on those charges.

Selenski’s lawyers had asked for Selenski to be moved from the State Correctional Institution at Frackville to the Luzerne County Correctional Facility so they can have adequate access to him to prepare for the upcoming trial.

Prosecutors had asked for Selenski to remain at the state prison and are reluctant to have him jailed at the county jail because of witness safety and security. Selenski escaped from the county jail in October 2003.

Muroski heard some brief arguments from parties involved in the case Thursday before determining he had no jurisdiction over the matter.

But he did request the state prison to move Selenski to the State Correctional Institution at Dallas so his attorneys can have “closer accessibility” to Selenski.

It is unclear whether the state prison will accommodate his request.

Hmmm, what do YOU think Frackville will do??????? DUH!!!

Judge requests that Selenski be housed at SCI-Dallas
Citizens Voice 1/11/2007 (no author cited)

Luzerne County Judge Chester Muroski requested Thursday that accused double murderer Hugo Selenski be transferred from Frackville to the State Correctional Institution at Dallas to facilitate preparations for his upcoming trial.
Selenski's attorneys, Stephen Menn, John Pike and Mike Senapee, had requested that Selenski be moved to the Luzerne County Correctional Facility so they would have better access to him as they prepare his defense.

After a hearing Thursday morning, Judge Muroski issued an opinion stating he does not have jurisdiction over the matter and that the state Commonwealth Court should determine where Selenski should be housed.

But he issued a formal request that Selenski be transferred to SCI-Dallas.
Selenski is accused of killing Tunkhannock-area pharmacist Michael J. Kerkowski and his girlfriend, Tammy L. Fassett.

Update: No ruling yet on Selenski’s housing

WILKES-BARRE – A judge on Thursday did not immediately decide which prison homicide suspect Hugo Selenski should stay in while he awaits trial.

They are awaiting trial on those charges.

Selenski’s lawyers asked for Selenski to be moved from the state prison to the Luzerne County Correctional Facility so they can have adequate access to him to prepare for the upcoming trial.

Prosecutors want Selenski to remain at the state prison and are reluctant to have him jailed at the county jail because of witness safety and security. Selenski escaped from the county jail in October 2003.

Judge Chester Muroski heard some brief arguments from parties involved in the case Thursday.

But he did not issue an immediate ruling.

He first has to decide whether he has jurisdiction to make such a ruling. A ruling could come down by Friday, he said.

Selenski will be housed at the county prison in the interim.

Hugo gets his hearing (one week late)

Times Leader, Thursday 1/11/2007
Hugo Selenski in Luzerne County Court today

(no author credited)

WILKES-BARRE – A Luzerne County judge will hear arguments this morning to determine where double-homicide suspect Hugo Selenski will be jailed while awaiting his trial.

Selenski, 33, has been jailed at the State Correctional Institution at Frackville where he is serving a two-year sentence for burning the bodies of Adeiye Keiler and Frank James.

The same jury cleared him of killing the two men after a two-week trial in March.

Selenski and Paul Weakley are now awaiting trial in the deaths of pharmacist Michael Kerkowski and his girlfriend, Tammy Fassett. The two went missing in May 2002.

Their bodies and the remains of Keiler, James and yet an unidentified person were found at the Kingston Township home where Selenski lived in June 2003.

Selenski’s lawyers, John Pike and Stephen Menn, want Selenski to be jailed at the Luzerne County Correctional Facility so they can have easy access to him while they prepare for the upcoming trial.

Prosecutors want Selenski to remain at the state prison and are reluctant to have him jailed at the county jail because of witness safety and security.

Selenski escaped from the county jail in October by climbing down a rope of bedsheets. He surrendered to authorities three days after his escape.
