Hugo Selenski Back in Court

WILKES-BARRE- "I just want to get to trial. Lupas is claiming in a motion that he's ready to go to trial but then he's complaining that we're wasting time. I mean let’s just get to trial. Let’s get to trial. It's been too long, it’s been years,” says Hugo Selenski, who’s accused of double murder.
Selenski lashed out inside a Luzerne County Courtroom Monday morning saying "That's not true. That's not true." His outburst happened after his attorneys didn't object to the District Attorney's stance on when he should go to trial for the deaths of Michael Kerkowski and Tammy Fassett.
“Hugo wants to go to trial. He wants his day in court. He wants to begin the trial as soon as possible," says defense attorney, John Pike.
“You'll see him be quite animated sometimes with regards to what's going on. And I think that's because Hugo has different ideas on how the case should proceed. But from a legal standpoint we as his lawyers tell him what we think is appropriate and how we should proceed and sometimes we disagree,” says Stephen Menn, another Selenski defense attorney.
District Attorney Dave Lupas says his team is ready to go to trial anytime, and that the delays caused thus far, have been created by Selenski's attorneys.
“We're ready to go. We're ready to proceed and to have the case move forward,” says Dave Lupas, Luzerne County’s District Attorney.
But, before the case can move forward, a key issue must be resolved. The judge must decide whether Selenski and co-defendant Paul Weakley will go to trial together or separately. The judge asked both the prosecutors and defense attorneys to review a recent decision made by the Pennsylvania Supreme Court regarding defendants being tried together.
"It's very important. It's prejudicial and the jury is confronted with a situation where they believe one defendant is guilty and the other is not. The issue of guilt by association comes up and it has a prejudicial effect on my client,” says Pike.
After the ruling on the potential split is made in March, other issues including trial dates, evidence admissibility, and other pre-trial motions can be decided.
It's a timeline that's frustrating for Selenski, whose no stranger to the legal system and its delays.
“I'm a little bit upset that the motions haven't been ruled on yet. They should be ruled on,” says Selenski.
For now, Selenski and Weakley are back behind bars.
The pair will be back in court March 15th, when both prosecutors and defense attorneys will argue for why they believe the cases should or shouldn't be separated.
